Terms of Service

1. Acceptance of Terms

By accessing and utilizing Seva Stack, you (the formal legal entity acting as an NGO, Trust, Society, or Section 8 Company in India) agree to comply with and be explicitly bound by these Terms of Service. If you do not agree with any part of these terms, you must immediately cease usage of our platform.

2. Service Description

Seva Stack is a cloud-based software-as-a-service (SaaS) platform designed explicitly to assist Indian Non-Governmental Organizations with constituent relationship management (CRM), donation tracking, and statutory compliance assistance (such as automated 80G receipt templates and Form 10BD/10BE reporting exports).

3. User Responsibilities & Compliance

While Seva Stack provides software to aid in generating tax receipts and tracking compliance:

• It is the sole responsibility of the NGO to ensure that all data input (including donor PANs, donation amounts, and unique transaction IDs) is legitimate and accurate.
• Seva Stack does not provide strict legal, financial, or tax advice. Organizations are solely responsible for ensuring their actual tax filings, FCRA returns, and legally mandated audits are thoroughly completed and lodged by an authorized Chartered Accountant (CA).
• You agree not to use the platform for any fraudulent or illegal fundraising activities whatsoever.

4. Subscriptions and Fees

Aspects of Seva Stack are offered on a subscription basis. We reserve the right to modify our pricing tiers at any time but will invariably provide at least 30 days prior written notice before any pricing changes fundamentally affect active, paid subscribers. Account refunds are handled strictly on a case-by-case basis as detailed during standard onboarding negotiations.

5. Termination & Data Portability

We reserve the right to suspend or terminate your operational access immediately, without prior notice or liability, for any genuine reason whatsoever, including without limitation if you severely breach these Terms of Service. Upon termination tied to fraudulent activity, data tied to the breach may be locked for regulatory reasons. However, standard offboarding allows for full secure CSV data export of your donor ledgers within 30 days of authorized termination.

6. Limitation of Liability

In no event shall Seva Stack, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any delay in statutory filing caused by the misconfiguration of the software strictly heavily on your behalf.
